Terms of Service Agreement

By purchasing a session, the Client acknowledges they have received, read, and agreed to all terms indicated in this agreement below and agrees to relay the details of this contract to any and all subjects involved in the session.

SERVICE AGREEMENT AND LIABILITY

The Client agrees that the Photographer shall provide services to photograph to the best of her abilities in accordance with the portrait session selected. Every effort will be made to assure your satisfaction according to industry standards. Any artistic interpretations by the photographer will be deemed acceptable and correct. The Photographer cannot be responsible for dissatisfaction due to circumstances beyond her control. In the event that photographic materials are damaged or lost through camera or computer malfunction the photographer liability will be limited to a retake of the session whenever possible or a refund of the cost of session fee if images cannot be retaken. If the session fee must be refunded (minus any credit card fees incurred by the Photographer), the Photographer will have no further obligation to the Client.

PAYMENT, RESCHEDULE AND CANCELLATION POLICIES

A non-refundable retainer is due upon booking. Any remaining balance of the total session fee is due once the final images are reviewed and approved by the Client. Images are not released until full payment is received.

Reschedules and cancellations: Sessions may be rescheduled due to inclement weather. If a Client needs to reschedule, please do so when absolutely necessary (e.g. illness, family emergency). Client may reschedule up to 2 times with no fee. Each reschedule after that will incur a $100 reschedule fee. Reschedules should take place within two months of the original session date or as soon as possible.

LATE ARRIVALS

In the event that the Client arrives late to the Portrait Session, the amount of time late will be deducted from the time allotted for the session. Photographer will not provide a refund or other compensation for the time deducted from the session due to late arrival of the Client. If Client is more than 30 minutes late, the session is deemed canceled and must be rescheduled.

COPYRIGHT AND REPRODUCTION

The Client agrees that all copyrights and/or intellectual property rights for all photographs taken at the session shall be held exclusively by Angelique Johnson Photography. The Client will receive images via digital download through their online gallery, and may print at their discretion. The client may also post images online and to social media (i.e. Facebook, Instagram, etc.) but is encouraged to credit/tag Angelique Johnson Photography where feasible. It is highly recommended the client back-up their images upon receiving them. The client may not sell, distribute or take credit for any of the photos taken by Angelique Johnson Photography.

LIABILITY RELEASE

The Client understands that Angelique Johnson Photography will not be held responsible for any injuries, illnesses, etc. that may or may not derive from this session. Any injuries, robberies, vehicle impoundment or towing, etc. that occur during or after the session will not be the liability or responsibility of Angelique Johnson Photography. If at any time, you are uncomfortable and wish to terminate that segment of the session, please communicate such to the Photographer.

MODEL RELEASE

The client grants that Angelique Johnson Photography may use any images taken at the session for the promotion of its business and services. Including but not limited to: website, blog, internal and external promotional material, and product demos. We do respect your privacy. Please let us know in advance and in writing if you prefer we NOT use your images for marketing purposes.

RESHOOT POLICY

Reshoots are at the sole discretion of the Photographer and will not be offered for things beyond the control of the photographer, such as: child/family behavior issues, poor clothing choices, makeup, weather related issues, or uncooperative subjects/not following the recommendations of the Photographer.

In the event of a reshoot, the Photographer shall make reasonable efforts to schedule the new session within her existing schedule. If this cannot be arranged, the Photographer shall return any paid fees or deposits associated with the session. The reshoot shall be limited to the session time of the original package, and only the new gallery will be edited and delivered to the Client. If Client wants both the original and reshoot galleries, a $175 fee shall apply for the additional editing and processing time.

LOCATION PORTRAIT SESSION DETAILS AND TERMS

All sessions will be with in the Greater Cincinnati area. Travel charges for sessions outside the area will be imposed.

FILE RETENTION

Due to the large amount of storage space required for the images created per year, RAW image files are preserved on my computer for 180 days. After which, all original RAW files may be deleted from my system. I keep an archived copy of the finished JPG files purchased for up to 1 year. The Client is responsible to backup photos once final digital photos are released and delivered.

EDITING AND RETOUCHING

The Photographer maintains a natural form of editing of the images. This includes first level editing and is in the form of basic color corrections, contrast enhancements, selective area adjustments, and artistic enhancements. The Photographer is granted total artistic control over the final image and the client understands that these are the steps we will take when referring to editing and/or retouching. If additional editing is requested after the images are delivered, the additional editing will be billed at $100 per image.
